Tourist and seasonal rentals in the Valencian Community: key differences

Not all short stays are regulated in the same way. In the Valencian Community, the real purpose of the stay, its duration and how it is marketed are key to identifying the applicable regime.

1. Tourist accommodation: up to 10 days to the same guest

Valencian tourism rules define a tourist-use dwelling, among other requirements, as an entire property made available for tourist purposes for 10 consecutive days or less to the same guest. The property must comply with the applicable tourism and planning rules and hold the relevant registration or enabling documentation.

Since 3 April 2025, an owner wishing to start tourist activity in a property subject to horizontal-property rules must also consider the requirement for prior express approval from the owners’ community under the Spanish Horizontal Property Law. The position of pre-existing activities can differ.

2. Seasonal rental: the temporary reason matters

Valencian tourism rules exclude rentals of 11 consecutive days or more to the same tenant from the definition of tourist-use dwelling. That does not automatically make every contract from 11 days to 11 months a valid “seasonal rental”: there should be a genuine temporary reason —such as work, studies, medical treatment or another temporary need— and the contract and supporting documents should reflect it consistently.

  • A contract adapted to the genuine temporary purpose.
  • Clear identification of the reason and expected duration.
  • Deposit and any other applicable obligations.
  • Avoid automatic practices or renewals that contradict the stated temporary nature.

The contract label is not enough

If the property is in reality being used to meet a permanent housing need, the arrangement may fall under the residential tenancy regime and its duration and renewal protections. The written contract should therefore match the reality of the occupation.

Can different strategies be combined?

An owner may consider different rental models at different times, but each must comply with the relevant tourism, planning, community, tenancy and tax rules. Before switching regime, it is sensible to review the property, the owners’ community, the municipality and the available documentation.
