Non-residents in Spain: tax representation and official notices
If you normally live outside Spain and own assets or have interests here, it is worth reviewing how official communications will reach you and whether your circumstances require you to appoint a representative.
Does every non-resident need a tax representative?
No. The obligation depends on the tax, the country of residence and the circumstances. For Spanish Non-Resident Income Tax, the Spanish Tax Agency explains that residents of EU Member States —and certain EEA states with mutual-assistance rules— do not generally have to appoint a representative resident in Spain. For residents of third countries, there are situations where appointment is compulsory, and the Tax Agency may also require it depending on the income or ownership of Spanish real estate.
The practical issue: notices and deadlines
Living abroad can make it easier to miss an official notice, request or administrative communication. Deadlines continue to run, and an unresolved matter can lead to surcharges, penalties or enforcement action.
