Inheritance in Spain for foreigners and non-residents
We assist foreign families and beneficiaries when an estate includes assets, rights or obligations located in Spain.
Cross-border inheritance matters
When the deceased or beneficiaries live outside Spain, foreign documents, succession rules and coordination between jurisdictions may need to be considered.
Spanish assets and inheritance tax
An estate containing Spanish assets may require deeds, tax filings, registrations and other formalities within specific deadlines.
Planning before an inheritance
Owners who want to organise matters in advance can also review our guidance on a Spanish will for foreigners.
Documents from another country
Cross-border estates often involve foreign death certificates, wills, certificates of last wishes or other documents. Depending on the document and country of origin, legalisation, an apostille or a sworn translation may be required before it can be used in Spain.
Spanish property and the Land Registry
When an inheritance includes real estate in Spain, the process may require coordination between the inheritance documentation, tax filing, notarial formalities and registration of the new ownership at the Land Registry.
Powers of attorney and remote coordination
Heirs who live abroad may be able to complete much of the process without repeated travel to Spain. We can review the case and coordinate documents, powers of attorney and the professionals involved where appropriate.
Deadlines and tax planning
Inheritance matters are subject to administrative and tax deadlines. Early review helps identify the documents required, the taxes that may apply and whether any extension or additional filing should be considered in time.
The information on this page is general. Each situation should be reviewed individually before taking action or making a decision.
