Spanish probate for British citizens: documents and steps to expect
British families often use the word “probate” for the whole estate process. In Spain, the practical work is spread across several stages: proving the succession, identifying the heirs and assets, dealing with tax, formalising the inheritance and registering any Spanish property.
Start with the succession documents
The first task is to establish the relevant will or heirship position and identify the documents that Spain will accept. Where documents were issued in the UK, apostille/legalisation and sworn translation may be required before they can be used before Spanish authorities or a notary.
Spanish certificates and the will position
The Spanish file can also involve Spanish civil-registry and last-will information, depending on the circumstances. A UK will and any Spanish will should be reviewed together so that the documents are not treated in isolation.
Identify the Spanish assets
Property, Spanish bank accounts and other Spanish rights should be identified and documented. For real estate, title and cadastral or tax information may be relevant to the valuation and notarial file.
Identify the heirs for Spanish purposes
Heirs who must complete Spanish tax or notarial formalities commonly need Spanish tax identification, including an NIE where applicable. If an heir is to be represented, the power of attorney must be suitable for the acts that need to be carried out.
File the Spanish inheritance tax
Modelo 650 is the Spanish inheritance-tax return for acquisitions following a death. For non-resident cases within the State Tax Agency's competence, its current guidance gives a general six-month filing period from the date of death. The authority and regional rules applicable to the estate must be confirmed.
Formalise and register inherited property
After the succession and tax documentation are in order, the inheritance of Spanish real estate can be formalised so that the change of ownership can be entered in the Land Registry. Only then is the Spanish property position properly reflected for future management or sale.
DOMUS coordination for UK families
DOMUS can coordinate the Spanish administrative side of the inheritance, including document review, NIE requirements, tax formalities and property follow-up, with the appropriate legal and notarial professionals where required.
Need help with a Spanish inheritance?
If you are in the UK and have inherited property or other assets in Spain, we can review the Spanish side of the file and explain the next practical steps.
Frequently asked questions
Is a UK Grant of Probate enough to transfer a Spanish property?
Not by itself. The Spanish property must be dealt with through the Spanish succession, tax, notarial and registration formalities applicable to the estate.
Will UK documents need to be translated?
Foreign documents used formally in Spain may require a sworn Spanish translation and, depending on the document, apostille or legalisation.
Can DOMUS coordinate with my UK solicitor?
Yes. Cross-border estates often work best when the Spanish and UK documentation is coordinated rather than handled as two disconnected files.
