Spanish inheritance tax for UK residents: Modelo 650 and the key deadline

If you live in the UK and inherit assets in Spain, Spanish inheritance tax can still apply. The important questions are what has been inherited, where the assets are located, which authority is competent and which rules apply to the particular estate.

Can Spain tax an inheritance received by a UK resident?

Yes. The Spanish Tax Agency explains that non-resident individuals can be liable for Spanish Inheritance and Gift Tax on assets and rights situated, exercisable or enforceable in Spain. A Spanish property is therefore a classic example of an asset that can create a Spanish inheritance-tax filing for an heir who lives abroad.

What is Modelo 650?

Modelo 650 is the Spanish inheritance-tax self-assessment for acquisitions “mortis causa” — assets received because of a death. In a cross-border estate it is important to distinguish the Spanish tax filing from any UK estate-administration obligations.

Do not wait for the entire UK estate to feel “finished” before checking the Spanish deadline. The Spanish filing timetable runs from the death and needs to be reviewed early.

The general six-month filing period

For non-resident cases handled by the Spanish State Tax Agency, the Agency's current electronic filing guidance states that Modelo 650 is generally filed within six months from the date of death (or from the date on which a declaration of death becomes final). The competent authority must still be checked in each case.

How much inheritance tax will a British heir pay?

There is no reliable single percentage that can be quoted for every British heir. The result can depend on the value and type of assets, the relationship between the deceased and the heir, the circumstances of the estate and the rules of the competent autonomous community. A calculation should be based on the actual file rather than a generic online rate.

Documents and valuation

The tax return is connected to the succession documentation and the value of the inherited assets. The Spanish Tax Agency's Modelo 650 documentation refers, among other things, to the death certificate, will or heirship documentation, representation where applicable, identification of heirs and evidence concerning inherited property and bank balances.

Inheritance tax is only one part of the process

Paying or filing the inheritance tax does not by itself complete the transfer of a Spanish property. The notarial and Land Registry position also needs to be dealt with so that ownership can be correctly recorded.

Frequently asked questions

What is the deadline for Spanish inheritance tax?

For non-resident cases within the State Tax Agency’s competence, its current guidance gives a general period of six months from the date of death. The competent authority should be confirmed for the estate.

Is there one inheritance-tax rate for UK residents?

No. The outcome depends on the estate and the rules applicable to the case, including the heir’s relationship to the deceased and the competent regional regime.

Is Modelo 650 the same as UK probate?

No. Modelo 650 is a Spanish inheritance-tax return. UK probate and Spanish tax, notarial and registration procedures are separate parts of a cross-border estate.
