Do British heirs need an NIE to inherit in Spain?
For many British heirs, the NIE is one of the first practical Spanish requirements that appears after a death. It is not the inheritance itself: it is the foreigner identification number used when dealing with Spanish tax and administrative procedures.
Why the NIE matters in an inheritance
An inheritance involving Spanish property or other Spanish assets usually creates tax and formal identification requirements. The Spanish Tax Agency's Modelo 650 documentation requires identification of the heirs, and a foreign heir will commonly need an NIE for the Spanish file.
When should the heirs arrange their NIE?
As early as practical once the heirs and the Spanish assets are known. Leaving the NIE until the last stage can slow down tax, notarial or registration work. If there are several heirs, each person's position should be checked separately.
Does every beneficiary automatically need one?
The exact requirement depends on what each beneficiary receives and which Spanish procedures they need to complete. An heir who must appear in a Spanish tax return, inheritance deed or property registration will commonly need Spanish tax identification. The correct approach is to review the role of each heir in the estate.
Can the NIE be coordinated from the UK?
Depending on the route used and the circumstances, NIE formalities can often be coordinated while the heir remains abroad. Representation may be possible in suitable cases. DOMUS can review the inheritance and the NIE requirement together rather than treating them as unrelated procedures.
NIE first, then the rest of the Spanish file
Once identification is in place, the inheritance can progress through the documentary review, tax filing, notarial formalisation and property registration that apply to the estate.

Frequently asked questions
Is an NIE the same as Spanish residency?
No. The NIE is an identification number for foreigners. Having an NIE does not by itself make a person resident in Spain.
Can several British heirs use the same NIE?
No. An NIE identifies an individual. Each heir who needs Spanish identification has their own number.
Should I wait until the inheritance deed is ready before applying?
Usually it is better to check the NIE requirement earlier, because it can be needed for tax and other formalities before the file reaches its final stage.
